A) The users of our Platform and the final Products available on it or facilitated by it shall be obligated to ensure that the Product is not being utilised for the following purposes:
1. instructions, how-to guides, information, or tools that allow unauthorised access to software, servers or other protected property, which are examples of hacking and cracking materials.
2. Facilitating and securing payment solutions by those who don’t themselves provide the content for which payments are being collected, such as payment gateways, digital agencies, or other aggregators.
3. any actions that shall amount to and/or be considered as an attempt to cheat and/or commit fraud against our End Users and/or Us. Product which contains or provides for, directly or indirectly with any type of vulgarity, including pornography, sexually explicit images, or obscenity, or promotes or enables the consumption of alcohol, drugs or any psychedelic material.
4. Products which contain or provide for content which is or can be considered pedophilic, harmful, harassment, blasphemy, racially or ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever that would constitute or encourage a criminal offense or that would otherwise give rise to liability or violate law(s) of the respective State.
5. upload to, distribute through or otherwise publish through the Platform any Product that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.
B) You are not permitted to use our Services if the Product:
1. does not require the End User to register or log in before making a payment and/or is HTML5-based. Additionally, providers of HTML5 games and content are prohibited from using our back-end integration API and must instead utilise our hosted payment pages only.
2. permits and/or provides for the use of any mechanism which allows for withdrawal of any value acquired through usage of their Product, in any unit of value.
C) For the End Users:
1. You will use the Platform only in a manner consistent with all laws and regulations and in accordance with the Terms.
2. You shall not impersonate or enter unsolicited details of any person on the any of the product avail on or associated with the Platform and/or the Company.
3. You shall not sell any products/merchandise; provide services of any manner to other End Users on and/or through any Product on our Platform.
4. You shall not gain access to and/or attempt to gain access to the account of other End Users with or without the permission of such End Users.
5. If the Product allows You to post content, you shall not post Content that involves and/or promotes in any manner illegal activities including but not limited to consumption of drugs, pornography, child pornography.
D) Both the End Users and the Customers inclusive of Users of DiscoveryPay, Publishers of Apptigo and Developers of TopUpkart shall note the above listed guidelines and shall ensure that they are strictly abided by before and during the entire term of their association with the Company and any change or failure in remaining compliant to these terms and/or the Terms of Use gives the Company an absolute right to remove, suspend or restrict their usage of the Services as applicable indefinitely.
